REFUND POLICY – GOODLY STORE

This Refund Policy describes when refunds are available for purchases you make from our online store at shop.thegoodly.com (the “Store”), operated by Dramotal Limited, Cyprus (“Goodly Store”, “we”, “us”), and how to request them. It supplements our Terms of Use and should be read together. Capitalised terms used but not defined here have the meanings given to them in our Terms of Use.

1. Scope

This Refund Policy applies to physical products purchased directly from us through the Store.

2. Damages and Losses in Transit

2.1 Please inspect your order upon receipt and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we may evaluate the issue and make it right.

2.2 Subject to your statutory rights under Section 5 below, we are not liable for products damaged or lost during shipping. If you received your order damaged, please contact the shipping carrier to file a claim. If you believe your parcel has been lost or undelivered, please first contact your shipping carrier for delivery status and double-check possible locations where the package may have been left.

2.3 We may, at our sole discretion and without any promise or guarantee to you, make reasonable efforts to assist you in resolving the issue, including by escalating the matter to our delivery partner once you share confirmation from your carrier. We may then decide, on a case-by-case basis, whether a reshipment, replacement or refund is appropriate.

3. Returns and Refunds

3.1 If you are unhappy with your item, please contact us. You must obtain refund approval from us before sending any items back. To initiate a return, please reach out to us within fourteen (14) days of the date of receipt of the item and specify the reason for your return request. Returns sent back without our prior approval will be accepted, but will not be eligible for a refund. This Section 3 does not affect any statutory right of withdrawal or other non-waivable consumer right that you may have under Section 5 below.

3.2 To be eligible for a refund, goods must be returned in a re-saleable condition. That means the item must be unused and in the same condition that you received it, including all original packaging. To complete your refund, we require a valid receipt or proof of purchase.

3.3 Once your returned item has been received and inspected, we will notify you of the approval or rejection of your refund. If approved, the refund will be processed and a credit will automatically be applied to the original method of payment within thirty (30) calendar days, unless a shorter period is required by applicable law.

3.4 You are responsible for paying your own shipping costs for returning your item. Shipping costs paid by you on the original order are non-refundable. If you receive a refund, the cost of return shipping arranged by us on your behalf (if any) may be deducted from your refund.

3.5 We recommend that you use a trackable shipping service and, where the value of the items returned is significant, consider purchasing shipping insurance. We do not guarantee that we will receive your returned item, and we are not responsible for items lost or damaged in return transit.

3.6 The fastest way to obtain a replacement item is to return the item you have (after receiving our authorisation) and, once the return is accepted, make a separate purchase for the new item.

4. Discretionary Refunds

Outside the cases set out in Sections 2, 3 and 5 of this Refund Policy, we do not operate a general voluntary returns programme and we are not obliged to accept returns or grant refunds. We may, at our sole discretion and in individual cases, agree to a return or a refund outside those circumstances, on such conditions as we may determine. Any such discretionary acceptance in a particular case does not commit us to granting refunds in other cases.

5. Statutory Consumer Rights

5.1 Nothing in this Refund Policy excludes, restricts or modifies any non-waivable consumer right or remedy available to you under the mandatory laws of your country of residence. The remedies set out in this Refund Policy are in addition to, and not in substitution for, any such statutory rights.

5.2 European Union and United Kingdom – right of withdrawal. If you are a consumer resident in the European Union, the United Kingdom or another jurisdiction that grants a statutory right of withdrawal for distance contracts, you have the right to withdraw from your contract with us for the purchase of physical products within fourteen (14) days, without giving any reason, starting on the day on which you (or a third party designated by you, other than the carrier) acquire physical possession of the goods. To exercise this right, send us an unequivocal statement of your decision to withdraw before the period expires (no prior approval required). You must return the goods within fourteen (14) days of notifying us of your withdrawal, you bear the direct cost of returning the goods, and we will reimburse you within fourteen (14) days of being notified of the withdrawal (we may withhold reimbursement until we have received the goods back or you have supplied evidence of dispatch, whichever is earlier).

6. How to Request a Refund

To request a refund, to exercise a statutory right of withdrawal, to report a defective, damaged or incorrect item, or for any other question about this Refund Policy, please contact us at support@thegoodly.com. Please include your order number and a brief description of the reason for your return. We will provide you with the applicable return address and any further instructions once your return has been approved.

7. Changes to this Refund Policy

We may modify this Refund Policy from time to time. Material changes will be notified through the Store or by other available means. The “Last Updated” date at the top of this Refund Policy indicates when it was last revised. Continued use of the Store after the effective date of any change constitutes your acceptance of that change.

8. Governing Law

This Refund Policy is governed by, and forms part of, our Terms of Use. The governing-law, dispute-resolution and arbitration provisions of our Terms of Use apply to any dispute arising under or in connection with this Refund Policy.
